A terrifying confrontation inside a Toledo, Ohio, restaurant was stopped when a quick-thinking waiter tackled an armed man who prosecutors say was trying to shoot his ex-wife.

The dramatic surveillance video has now drawn renewed attention after the former Ohio attorney was convicted of attempted murder and other charges. The waiter who intervened is speaking publicly about the moment he realized a woman at the restaurant was in danger.

Former Attorney Walked Into Restaurant Armed

The incident happened on April 11, 2025, at Sabira, a restaurant in downtown Toledo.

According to prosecutors, Matthew Exton, 43, had been drinking at a neighboring restaurant when he spotted his former wife, Kayda Valone, dining with her family at Sabira. Prosecutors said Exton initially entered the restaurant, sent a drink to the table and then left after spitting toward the group.

He later returned carrying a handgun.

Surveillance footage shows Exton approaching Valone's table and pointing the weapon at her. He pulled the trigger, but the gun did not fire because its safety was still engaged. Prosecutors said he attempted to manipulate the weapon to fire again when the waiter rushed toward him.

Waiter Tackles the Gunman

The waiter moved quickly, tackling Exton before he could fire the weapon.

Other restaurant patrons also helped restrain him as people scrambled to get away from the unfolding confrontation.

The firearm was loaded, with one round in the chamber and seven more rounds in the magazine, according to prosecutors. The intervention prevented the situation from becoming even more deadly.

Jury Convicts Exton

A Lucas County jury found Exton guilty of attempted murder, two counts of felonious assault and multiple firearm specifications. He was acquitted of a third felonious assault charge.

During the trial, Exton denied that he intended to kill his ex-wife. He testified that he was emotionally distressed following their 2024 divorce and claimed he was trying to pressure her over the sale of their former home.

Prosecutors presented the restaurant surveillance footage and argued that Exton had deliberately returned with a loaded firearm to confront Valone.

A Chilling Moment Caught on Camera

The footage has since circulated widely online, giving viewers a disturbing look at how quickly an ordinary dinner turned into a potentially deadly attack.

The restaurant was filled with customers when Exton approached the table. The sudden appearance of a gun sent people scrambling, while the waiter and other men moved toward Exton.

Prosecutors praised the restaurant staff and patrons who intervened, saying their actions helped prevent further violence.

Exton Faces Up to 25 Years in Prison

Exton's law license was suspended following the incident. He is scheduled to be sentenced on Sept. 21, 2026, and faces up to 25 years in prison.
