KJ Biermann, 15, Pleads NOT GUILTY to Seven Felonies Amid Sexual Battery and Sodomy Investigation
According to court documents filed by his attorney Jason Sheffield on Oct. 5, Biermann entered not-guilty pleas to every count and waived a formal arraignment that had been scheduled for later this month. His legal team has also asked the court to transfer the case from Fulton County Superior Court to juvenile court.
Seven Felony Charges
Biermann was indicted by a Fulton County grand jury in September on seven felony counts, including aggravated child molestation, aggravated sexual battery, aggravated sodomy, false imprisonment and three counts of sexual battery against a child under 16.
The charges stem from an alleged April 23 incident involving a teenage girl at a fitness center in Alpharetta, Georgia. Authorities say the girl reported the alleged assault to police the following day.
Biermann has denied the allegations through his attorney and has pleaded not guilty. A criminal charge or indictment is not a finding of guilt.
Defense Wants Case Moved to Juvenile Court
Biermann's attorney is asking a judge to schedule a hearing to determine whether the case should be transferred to Fulton County Juvenile Court.
The request could significantly change how the case proceeds. Biermann is currently being prosecuted in Superior Court as an adult, while his legal team is seeking to have him handled through the juvenile system instead.
His attorney previously criticized the decision to prosecute the teenager as an adult and said the defense expected Biermann to plead not guilty to every charge.
Kim Zolciak Has Defended Her Son
Zolciak has repeatedly maintained that her son is innocent.
Following his arrest, she called the allegations “reckless and deeply troubling” and said Biermann categorically denied the accusations. She also said her son voluntarily took a polygraph examination and that a sexual-assault examination of the alleged victim did not identify DNA belonging to him.
The defense has emphasized those points while preparing to challenge the prosecution's case.
Prosecutors Have Raised Additional Concerns
The case has also taken a more complicated turn following claims made by prosecutors about evidence allegedly discovered on Biermann's cellphone.
During an earlier hearing, prosecutors alleged that investigators found videos involving Biermann and an underage family member. Those allegations are separate from the April incident that resulted in the seven-count indictment, and Biermann has not been convicted of any offense related to them.
Prosecutors have subsequently sought permission to conduct forensic interviews involving additional minors, although the court filings did not publicly identify the children or provide details about the interviews.
Strict Conditions Following His Release
Biermann was arrested in August and spent several weeks at Atlanta's Metro Regional Youth Detention Center before a judge granted him a $200,000 bond.
His release comes with strict conditions, including electronic monitoring, virtual schooling and restrictions on contact with the alleged victim and other minors. He is also prohibited from using a cellphone or social media under the reported terms of his release.
What Happens Next
The immediate focus is now on Biermann's request to have the case transferred to juvenile court.
The judge will ultimately determine how the prosecution moves forward, while the defense continues to challenge the allegations and seek a different legal venue for the teenager.
For now, Biermann remains presumed innocent unless and until proven guilty in court.
